Andrew W. Holbrook

Andrew “Drew” Holbrook is an associate at Lewis Gianola PLLC’s Charleston, West Virginia office. Mr. Holbrook’s practice focuses primarily on insurance, construction, and real estate and property law with a focus on litigation. Mr. Holbrook’s real estate practice includes a substantial focus on imminent domain on behalf of the State of West Virginia as well as protecting the interests of current and former real property owners in property disputes. Mr. Holbrook’s insurance practice includes obtaining coverage of policy holders, defending claims against policy holders, and subrogation on behalf of insurers. Mr. Holbrook’s focus in construction includes representing property owners against contractors for breach of contract, general contractor and sub-contractor contract disputes, and assisting contractors in filing and enforcing mechanic’s liens. Mr. Holbrook was born and raised in Charleston, West Virginia. He graduated from West Virginia University and West Virginia University College of Law. Mr. Holbrook lives in South Charleston with his wife and two daughters.

Mr. Holbrook has experience litigating cases at all levels in West Virginia. Mr. Holbrook works with clients to develop facts and investigate claims and defenses efficiently and quickly to obtain the best requests for his clients. Drew has experience reviewing construction contracts, insurance policies, rules and regulations of the State of West Virginia, buildings plans, and engineering documents, and he has experience researching the applicable laws of West Virginia to effectively litigate any claim or defense for his clients.

Mr. Holbrook has extensive experience litigating claims on behalf of all parties to a construction project for breach of contract, fraud, misrepresentation, quantum meruit, unjust enrichment, breach of warranty, and negligence. Mr. Holbrook has represented property owners in litigation for multi-million-dollar projects. Mr. Holbrook is familiar with the standardized American Institute of Architects (AIA) contracts and forms and the 2018 adaptations of the International Code Council (ICC) codes. Mr. Holbrook has also represented materialmen, suppliers, sub-contractors, and general contractors in filing and enforcing their statutory mechanics lien rights against property owners who failed or refused to pay for the labor and materials provided to them.

Mr. Holbrook has experience representing insured, insurer, and injured parties. Mr. Holbrook uses his experience and knowledge to effectively obtain the resolution his clients desire, or if necessary, to litigate to trial any cause of action or defense. Drew also has also represented insurance carriers for their subrogation rights in claims against at-fault parties.

Mr. Holbrook has represented real property owners to protect their rights against at-fault parties who cause damage or otherwise trespass on their property. Mr. Holbrook’s practice also includes representing agencies of the State of West Virginia in imminent domain matters, assisting the State in their goals in completing projects for public purposes in condemnation proceedings.

In all areas of Drew’s practice, he works diligently and passionately with his clients to achieve a goal that is in the best interests of his clients. Mr. Holbrook prepares and informs his clients of their rights, remedies, and possible outcomes, favorable or not, and provides candid advice so that clients may be in the position to make their decisions.
