Natural Gas/Shale Midstream

Lewis Gianola’s Midstream Group has a strong track record of providing legal assistance to mid-stream companies regarding the construction and operation of intrastate pipelines and gathering lines located in the Marcellus/Utica fairway. The firm also has provided representation to local distribution companies, intrastate pipelines and other utilities before state public service commissions. We also have provided representation in regulatory and permitting proceedings in several states and on the federal level.

The firm’s team of real estate attorneys routinely handle the acquisition of property associated with pipelines, including right of ways for interstate pipelines, associated compressor stations and related infrastructure. Lewis Gianola also has particular expertise in eminent domain, condemnation law, land use planning and zoning law, as well as negotiating and closing complex real estate transactions.

Lewis Gianola’s pipeline litigation experience includes: injunctions for survey access, large scale negotiations and mediations with landowners and municipalities, litigation battles with coal companies crossed by a high pressure natural gas pipeline, obtaining equitable relief for immediate possession and construction of a FERC certificated natural gas pipeline project, and multiple trials to determine compensation for landowners crossed by a natural gas transmission pipeline.

Other highlights of our practice’s experience include:

  • Representing a multinational oil and natural gas company in a large-scale federally regulated pipeline project across the State of Ohio

  • Providing counsel regarding a FERC regulated interstate pipeline being constructed across West Virginia
